As more corporations cover abortion travel in medical insurance plans, are interstate travel bans next?

Even before the Supreme Court overturned Roe v. Wade, 11 states limited whether employer-based insurance policy could cover abortions with exceptions for rape, incest, life endangerment, and fetal impairment.

But those states, which include Texas, Indiana, and Oklahoma, couldn’t prevent plans from covering out-of-state abortions, said Harvey Cotton, a principal lawyer inside Ropes & Gray’s advantages consulting group.

Because the Court’s ruling paved the way in which for some states to pass abortion bans, a slew of corporations including Google, Kroger and Disney offered employees out-of-state coverage and reimbursement for travel expenses.

Nevertheless it’s too early to inform whether those advantages will make it through inevitable future legal challenges.

Does private medical insurance cover abortions?

Before Dobbs v. Jackson Women’s Health Organization, which resulted in Roe getting overturned, “employers who desired to offer a broad scope of reproductive health advantages could achieve this,” Cotton said, apart from plans that were fully insured.
